The Federal Council has opened the consultation procedure on a proposal for revision of the Therapeutic Products Act (HMG 3b).

The proposed reform provides for elements of liberalisation for medicinal products, as well as a new supervisory financing mechanism for medical devices.

The proposal primarily covers the following key changes:
  • Liberalisation of mail-order sales of certain medicinal products, including the removal of the prescription requirement for certain non-prescription medicines sold by mail order.
  • New supervisory levy for medical devices, introducing an additional regulatory fee for manufacturers and importers.
  • Measures to address medicine shortages, including simplified imports of equivalent products, streamlined marketing authorisations for well-established medicines, and expanded manufacturing and supply authorisations for pharmacies during supply disruptions.
  • Clearer rules on dispensing individual quantities of medicinal products tailored to patients' treatment needs.
  • Expanded prescribing rights for chiropractors, bringing their competencies closer to those of other university-trained healthcare professionals.

The consultation procedure runs until 16 October 2026.

For affected industries, the reform could create both business opportunities and new compliance and cost risks, if ultimately implemented by parliament.
