Eric Stupp explores the tendency in the private wealth business in Switzerland to use financial instruments and collective investment schemes which have been set-up by its own asset management arm of the financial intermediary. This trend was re-enforced by the retrocession decisions of the Swiss Federal Supreme Court to either pass on to clients or to disclose retrocessions received from third parties. FIDLEG and similar statutes in the EU define a clear framework which are relevant when banks offer its “own” financial instruments.
