Bär & Karrer Successfully Represents a Major Pharmaceutical Company in Swiss Federal Supreme Court Case
Bär & Karrer arbitration specialists Daniel Hochstrasser and Simone Stebler successfully defended a major Swiss pharmaceutical company in proceedings brought by the opposing party to set aside an ICC award before the Swiss Federal Supreme Court. By judgment rendered on 8 October 2014 (4A_199/2014), the Swiss Federal Supreme court dismissed the application of the Eastern European distributor for judicial review of an ICC award and ordered it to compensate our client for attorneys' fees and costs.
The proceedings arose after an ICC arbitral tribunal fully rejected the Eastern European distributor's claims of over USD 120 million. In these arbitration proceedings, Bär & Karrer (Daniel Hochstrasser, Simone Stebler and Anne-Florence Bock) successfully acted as counsel for the Swiss pharmaceutical company.
